These Terms and Conditions (“Terms”) govern your access to and use of the Mind-Pro digital service (“Service”), owned and operated by one81 (Pty) Ltd, a company registered in the Republic of South Africa (“one81”, “we”, “us”, or “our”).
By subscribing to or using the Service, you agree to be bound by these Terms.
1. SERVICE OVERVIEW
Mind-Pro is a digital-only platform that enables users to:
- Complete personal profiling
- Access personalized content
- Set and track personal goals
- Engage with productivity-focused tools and features
- Subscribe to premium content and features
The Service is delivered via mobile and/or web-based interfaces and may be accessed through Mobile Network Operators (“MNOs”) and associated partners.
2. ELIGIBILITY
- You must be 18 years or older to use the Service.
- By subscribing, you confirm that you have the legal capacity to enter into a binding agreement.
- Use of the Service is limited to users located in South Africa and Zimbabwe.
3. SUBSCRIPTION & BILLING
3.1 Carrier Billing
- The Service is billed via your mobile network operator using carrier billing.
- Your MNO acts as the merchant of record, and all billing is processed by or on behalf of your MNO.
3.2 Billing Frequency
- Subscription fees may be charged on a:
- Daily basis, or
- Weekly basis, depending on the product offering selected.
3.3 Consent to Charges
By subscribing, you:
- Authorize your MNO to charge your mobile account or deduct from your prepaid airtime
- Acknowledge that charges will recur automatically until you cancel
3.4 Pricing
- Pricing is communicated at the point of opt-in (e.g. USSD, SMS, web, or app interface)
- All charges include applicable taxes unless otherwise stated
3.5 Billing Notifications
- You may receive SMS notifications confirming:
- Subscription activation
- Ongoing billing
- Renewal reminders, as required by your MNO and applicable regulations
4. ACTIVATION & OPT-IN
- Subscription may occur via:
- USSD
- SMS (including double opt-in where required)
- Web or mobile interfaces
- You will only be subscribed after completing the required opt-in process in accordance with MNO and regulatory requirements
5. CANCELLATION & REFUNDS
5.1 Cancellation
- You may cancel your subscription at any time via:
- The method provided by your MNO (e.g. USSD, SMS, or customer support), or
- Within the Service interface (where applicable)
- Cancellation will take effect in accordance with your MNO’s policies
5.2 Refunds
- Refunds (if any) are governed by the policies of your MNO as the merchant of record
- one81 does not process or guarantee refunds directly
6. NATURE OF THE SERVICE (IMPORTANT DISCLAIMER)
- Mind-Pro provides general productivity, educational, and informational content only
- The Service:
- Does not provide medical, psychological, or therapeutic advice
- Does not diagnose, treat, or prevent any condition
- Does not involve licensed healthcare professionals
You should seek appropriate professional advice where necessary.
7. USER RESPONSIBILITIES
You agree to:
- Provide accurate and truthful information during profiling
- Use the Service for lawful purposes only
- Not misuse, copy, distribute, or reverse engineer any part of the Service
- Not attempt to gain unauthorized access to systems or data
8. INTELLECTUAL PROPERTY
- All content, features, and functionality are owned by one81 (Pty) Ltd
- This includes: Text, graphics, software, algorithms, and content
- You are granted a limited, non-exclusive, non-transferable license for personal use only
You may not:
- Reproduce, distribute, or exploit any content without prior written consent
9. DATA USAGE & PRIVACY
- The Service collects and processes user engagement and behavioral data
- No medical or clinical records are stored
Your use of the Service is also governed by our Privacy Policy (to be provided separately), aligned with:
- Protection of Personal Information Act
- Zimbabwe data protection legislation
10. SERVICE AVAILABILITY
- The Service is provided on an “as is” and “as available” basis
- We do not guarantee:
- Continuous availability
- Error-free operation
- Compatibility with all devices or networks
Service delivery may depend on third parties, including MNOs.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- one81 shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Service interruptions caused by MNOs or third parties
- Your use of the Service is at your own risk
- Total liability (if any) shall not exceed the total subscription fees paid by you in the preceding 30 days
12. INDEMNITY
You agree to indemnify and hold harmless one81, its directors, employees, and partners from any claims, damages, or losses arising from:
- Your misuse of the Service
- Your breach of these Terms
- Your violation of any law or third-party rights
13. THIRD-PARTY DEPENDENCIES
- The Service relies on third-party infrastructure, including MNO networks
- one81 is not responsible for:
- Billing errors by MNOs
- Network outages
- Delays or failures in message delivery
14. MODIFICATIONS TO THE SERVICE
- We may:
- Modify, suspend, or discontinue features at any time
- Update content or functionality without notice
Continued use constitutes acceptance of such changes.
15. AMENDMENTS TO TERMS
- These Terms may be updated periodically
- Updated versions will be made available through the Service or relevant channels
- Continued use after updates constitutes acceptance
16. TERMINATION
We may suspend or terminate your access if:
- You breach these Terms
- Required by law or MNO partner obligations
17. GOVERNING LAW & JURISDICTION
- These Terms are governed by the laws of the Republic of South Africa
- Where required, applicable laws of Zimbabwe will apply to users in that jurisdiction
You consent to the jurisdiction of South African courts, unless otherwise required by local law.
